Fake Fertilizer importation case against Elgeyo Kenya resumes in March


A Case in which three Directors of a Fertilizer firm and KRA officials are facing charges of importing substandard fertilizer is almost coming to a close with three witnesses remaining.

Bimal Rajnikant Kantaria , Iqbal Mohammed and Baiju Kantaria, had been charged with 7 counts of willful disobedience statutory duty.

The other charges include abuse of office, connivance to commit an offence and negligence of official duty.

The case is being heard before Nairobi senior Principal Magistrate Kennedy Cheruiyot whereby a total of 14 witnesses have already testified.

The prosecution had sought for adjournment to produce the remaining witnesses in the matter.

The directors were charged alongside KRA officials in 2018 over the importation of substandard fertilizer.

It is alleged that on 30th June 8018 Kiprono Vullut and Ahmed Ashkir Dahir connived to release a consignment of substandard potassium nitrate fertilizer to Elgon Kenya limited vide entry number 2018/MSA6925160, which fertilizer did not meet the specified standard for potassium nitrate.

Irene Githendu, Kiamba clearing and forwarding limited and Elgon Kenya were further charged that on 18th to 30th June 2018 in Mombasa county being clearing agents and the importers jointly with others not before court willfully disobeyed the provisions of section 20 of the standards act .

Kantaria a prominent industrialist was early this year feted with a Honorary Doctorate of Humanities degree by the United Graduate College and Seminary International, a US-based theology college, for his efforts at promoting agriculture in East Africa.

Kantaria works with the youth in building capacity for the future. Elgon Kenya has brought more youth into farming through new technologies and projects.

The company runs the annual National Farmers Awards, now in its seventh year, which rewards Kenya’s best food producers.

Since its pioneer edition, it runs a youth category that has inspired a new generation of young farmers who are mentored by the winners.

The hearing will proceed March 2, this year.
